Terms of Service

1. Introduction and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and App Snap Ltd ("Company", "we", "us", or "our"), a company registered in England and Wales, governing your access to and use of the Wishlist application and website (collectively, the "Service"). The Service may also be made available under the brand name "Wishlo".
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to use the Service. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
2. Description of the Service
Wishlist is a software-as-a-service ("SaaS") platform that enables users to create, manage, and share universal wishlists. The Service includes, but is not limited to, the following features:
- Adding items to wishlists by pasting product URLs from any online retailer;
- Sharing wishlists with friends, family, and other third parties;
- Group gifting functionality, allowing multiple users to contribute towards items on a shared wishlist;
- Generation and tracking of affiliate links associated with wishlist items;
- Analytics and insights relating to wishlist engagement and interactions;
- Team collaboration features for business account holders; and
- API access for business account holders to integrate the Service with third-party systems.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
3. Account Registration and Security Obligations
To access certain features of the Service, you must register for an account. When registering, you agree to provide accurate, current, and complete information and to keep such information up to date. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any unauthorised use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to comply with this section.
You may not create multiple accounts for the purpose of abusing the free tier or any promotional offer. Each individual or organisation is permitted one free account unless otherwise agreed in writing.
4. Subscription Plans
The Service is offered under the following plans:
- Free Plan: Includes up to 3 wishlists and a maximum of 30 items per account. Basic sharing functionality is included. Affiliate links, group gifting, and analytics features are not available on the Free Plan.
- Pro Plan (£4.99/month or £39.99/year): Includes up to 500 items per account, affiliate revenue sharing, analytics and insights, group gifting functionality, and priority support. Annual billing is offered at a discounted rate equivalent to approximately two months free compared to monthly billing.
- Business Plan (£19/month or £190/year): Includes unlimited wishlists, unlimited items, team seats for multiple users within an organisation, full API access, advanced analytics, group gifting, affiliate revenue sharing, and dedicated support. Annual billing is offered at a discounted rate.
Plan prices are stated in pounds sterling (£) and include applicable VAT where required. We reserve the right to change pricing with at least 30 days' prior written notice (which may be given by email or via a notification within the Service).
5. Billing, Free Trial, Auto-Renewal, and Cancellation
All payments are processed securely through Stripe, Inc. ("Stripe"). By subscribing to a paid plan, you authorise us to charge the applicable fees to your chosen payment method via Stripe. We do not store your full payment card details on our servers; all payment data is handled by Stripe in accordance with the Payment Card Industry Data Security Standard (PCI DSS).
Free Trial. New subscribers to the Pro or Business plan are entitled to a 14-day free trial. The free trial begins on the date you subscribe and ends 14 days later. If you do not cancel before the end of the trial period, your subscription will automatically convert to a paid subscription and your payment method will be charged the applicable fee. We may require valid payment method details at the time of signing up for the free trial.
Auto-Renewal. Paid subscriptions automatically renew at the end of each billing period (monthly or annual, as selected at the time of subscription) unless you cancel before the renewal date. The renewal charge will be made to the same payment method used for the initial subscription.
Cancellation. You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, your subscription will remain active until the end of the current billing period, after which your account will revert to the Free Plan. No partial refunds are provided for the unused portion of a billing period, except as required by applicable law or as set out in our Refund Policy (Section 6).
6. Refund Policy
All subscription fees are generally non-refundable. However, we recognise that there may be exceptional circumstances. If you believe you are entitled to a refund, please contact us at the address provided in Section 15 within 14 days of the charge in question. We will review refund requests on a case-by-case basis and, at our sole discretion, may issue a full or partial refund.
Where a statutory right to a refund exists under applicable consumer protection legislation (including but not limited to the Consumer Rights Act 2015), such statutory rights shall not be excluded or limited by these Terms.
Refunds, where granted, will be processed to the original payment method within 14 business days and may take up to 10 additional business days to appear on your statement.
7. User Content Responsibility
You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, irrevocable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content solely for the purposes of operating and improving the Service.
You are solely responsible for your User Content and represent and warrant that:
- Your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party;
- Your User Content is not illegal, defamatory, libellous, obscene, threatening, abusive, or otherwise objectionable;
- Your User Content does not contain malware, viruses, or any other harmful code;
- Where your User Content includes product URLs or affiliate links, you will ensure that proper disclosure is made in accordance with applicable advertising and consumer protection regulations, including the UK Advertising Standards Authority's CAP Code and the Consumer Protection from Unfair Trading Regulations 2008.
We reserve the right to remove or refuse to display any User Content that, in our reasonable opinion, violates these Terms or applicable law, without liability to you.
8. Affiliate Disclosure
The Service may generate affiliate links for products added to wishlists. When another user clicks on an affiliate link and makes a purchase from the linked retailer, App Snap Ltd may earn a commission from that retailer. This commission is paid by the retailer and does not result in any additional cost to the purchaser.
This disclosure is made in compliance with the UK Advertising Standards Authority's CAP Code, the Consumer Protection from Unfair Trading Regulations 2008, and the Consumer Rights Act 2015. Affiliate relationships may exist with retailers whose products are linked through the Service, and such relationships do not influence the placement or ranking of items within your wishlists.
Pro and Business plan subscribers may be eligible to receive a share of affiliate revenue generated through their wishlists, as described in the applicable plan features. The allocation and payment of affiliate revenue sharing is at our sole discretion and may be subject to separate terms.
9. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and shall remain the exclusive property of App Snap Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks, trade dress, and trade names (including "Wishlist" and "Wishlo") may not be used in connection with any product or service without the prior written consent of App Snap Ltd.
You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your personal or internal business purposes, subject to these Terms. You may not: (a) copy, modify, or distribute any part of the Service; (b) reverse engineer, decompile, or disassemble any software used in the Service; (c) access the Service by any means other than through the interfaces we provide; or (d) use the Service for any purpose that is unlawful or prohibited by these Terms.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall App Snap Ltd, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; or
- Unauthorised access, use, or alteration of your transmissions or content.
In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the Service, whether in contract, tort (including negligence), statutory, or any other legal theory, exceed the amount of fees paid by you to us during the twelve (12) months immediately preceding the event giving rise to the claim, or £100, whichever is greater.
Nothing in these Terms shall exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.
11. Indemnification
You agree to indemnify, defend, and hold harmless App Snap Ltd and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service;
- Your User Content or any content you submit, post, or transmit through the Service;
- Your violation of these Terms or any applicable law or regulation; or
- Your violation of any rights of a third party, including intellectual property rights, privacy rights, or proprietary rights.
We will provide you with reasonable notice of any such claim and reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification. You agree to cooperate with our defence of such claim.
12. Termination Rights
By You. You may terminate your account at any time by contacting us or using the account settings within the Service. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms which by their nature should survive termination shall remain in effect.
By Us. We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
Upon termination, your right to use the Service will immediately cease. We are not obliged to retain your User Content following termination and may delete such content in accordance with our data retention policy. We will use commercially reasonable efforts to provide you with an opportunity to export your data before deletion.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with these Terms or the use of the Service. Nothing in this clause shall limit our right to take proceedings against you in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdiction.
14. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Notice of changes will be provided by posting the revised Terms on this page and, where appropriate, by sending an email notification to the address associated with your account. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed of any updates. The "Last updated" date at the top of this page indicates when these Terms were last revised.

16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions shall not in any way be affected or impaired. If such modification is not possible, the invalid, illegal, or unenforceable provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
